There are certain best practices and restrictions that you need to be aware of, which we get into below.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">What is section 321 and how do I declare it?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Section 321, or &#8220;de minimis value clearance&#8221; essentially means that <\/span><b>you can import your freight into the USA without having to pay duty <\/b><span style=\"font-weight: 400;\">as long as the value of your cargo is under $800 USD.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In order to declare section 321, you generally don\u2019t need an eManifest or a formal entry. For shipments that do need an eManifest anyway, you\u2019ll need to indicate that to your customs broker, who will know the steps to take in order for your cargo not to be dutied. Keep in mind that <\/span><b>you will still need to provide a valid commercial invoice to the carrier<\/b><span style=\"font-weight: 400;\">, as well as <\/span><b>list a customs broker<\/b><span style=\"font-weight: 400;\"> (even if you don\u2019t end up using one).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you happen to be clearing the cargo yourself, follow the steps below:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Select the shipment type \u201cSection 321\u201d within the ACE eManifest<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Enter your shipment control number<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Include the details about your shipment that you would include on the customs\/commercial invoice such as<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The shipper\u2019s information<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The consignee\u2019s information<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The commodity being shipped<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The value of your shipment<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The country of origin<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3><span style=\"font-weight: 400;\">What restrictions apply to Section 321 cross-border shipping?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">You will not be able to ship the following types of goods duty-free:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Goods regulated by some of Participating Government Agencies (PGAs) such as:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Food and Drug Administration (FDA)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Food Safety Inspection Service (FSIS)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">National Highway Transport and Safety Administration (NHTSA)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Consumer Product Safety Commission (CPSA)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">\u00a0U.S. Department of Agriculture (USDA)<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Merchandise subject to Anti-Dumping Duty (ADD) and\/or Countervailing Duty (CVD)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Goods needing inspection as a condition of release, regardless of value<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Exceptions to this rule include:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Beauty products &amp; cosmetics<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Tableware<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Non-medical devices that emit radiation<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Biological samples for laboratory analysis<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Foodstuffs<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">When it comes to food, there are certain commodities that still need to be inspected and, as a result, will still be subject to duty fees, such as: foods packed in airtight containers stored at room temperature, raw mussels, raw oysters, raw clams, puffer fish, and ackees.<\/span><\/p>\n<p><b>Daily restrictions may apply<\/b><span style=\"font-weight: 400;\"> that are not related to your product. If you are shipping goods that are not sent as gifts (which require their own certificates), you may be limited in the amount of cross-border shipping that you can do under Section 321 in a single day. That means that <\/span><b>you can only ship one article cross-border per day<\/b><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">To round up<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/h3>\n<p><b>You can import one article per day into the USA under Section 321 if it meets all of the criteria listed above.<\/b><\/p>\n<p><span style=\"font-weight: 400;\">You will still need to provide the carrier with a customs invoice and a customs broker (to avoid delays in case one is needed).
